EMERCOM of Russia: from July 1, 2021 a new supervision system will start to operate

On November 17, under the chairmanship of Anatoly Suprunovsky, Deputy Minister of EMERCOM of Russia - Chief State Fire Inspector of the Russian Federation, a seminar was held to clarify the procedure and criteria for classifying protection facilities into a certain risk category.

Representatives of the Prosecutor General's Office and the Ministry of Economic Development took part in the event.

Via videoconference, representatives of the territorial departments of the state fire supervision of the EMERCOM of Russia got answers to the questions related to the application of the Federal Law of July 31, 2020 No. 248-FZ "On State Control (supervision) and Municipal Control in the Russian Federation."

“Unlike the current regulation, not to groups of facilities, but each facility will be assigned to certain category. The risk category defining is carried out on the basis of the indicator of the severity of the potential negative consequences of the fire and the responsibility of the person under control in compliance with the fire safety requirements at the facility,” Anatoly Suprunovskiy explained, opening the seminar.

The new control system of the Russian Emergencies Ministry will start operating on July 1, 2021 It retains some of the well-established mechanisms of state supervision, which have proven their effectiveness in practice, and introduces new aspects of control. For example, the EMERCOM of Russia will continue to monitor the authorities of the constituent entities of the Russian Federation and local governments over the implementation of their powers. In addition, the new law establishes the priority of preventive work and introduces 7 possible types of preventive measures. However, inspections are not the only control activity. The new law provides for 10 control methods. In particular, the inspector will be able to assess compliance with fire safety requirements during field surveys. This type of supervision measures does not provide for contact with a legal entity or individual entrepreneur, but is based solely on a visual inspection of the facility by an inspector. Within its framework, for example, an employee of the state supervision department can visit a shopping center by inspecting premises that are publicly accessible to visitors, such as a trading floor or common areas. If it is necessary to respond promptly to violations of fire safety requirements that pose a real threat, the inspector can make an “inspection visit”. Its duration does not exceed one day and does not require advance notice. The inspection time will be reduced from 20 to 10 working days.

The Russian Emergencies Ministry has formed an online calculator service, which will allow specialists determine the risk category for each facility. To date, the service has been tested by the regional departments of the state fire control of the Russian Emergencies Ministry. From the beginning of next year, the "online calculator" will be posted on the Department's portal and will become available to entrepreneurs who will be able to control the assignment of facilities to one of 6 risk categories. The frequency of inspections depends on the risk category and hazard level of the facility.

A number of points of the new federal law require clarification. For this, a satellite law is being developed, which will amend the sectoral legislation. At the same time, work is underway to introduce information technologies into the state fire control, which make it possible to minimize contacts with the persons being checked.
